1. Introduction
These Terms of Service govern your use of heritagebluemountaincoffee.com and your purchase of products from Heritage Blue Mountain Coffee. By accessing the site, creating an account, or placing an order, you agree to these Terms and to the policies linked from the site.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and legally capable of entering a binding agreement to use the site or place an order.
3. Products, authenticity, and availability
Heritage Blue Mountain Coffee offers authentic JACRA-certified Jamaican Blue Mountain Coffee. Products are subject to availability, and we may limit quantities because of seasonal supply. We work to display product descriptions, images, colors, availability, and pricing accurately, but errors can occur. Unless otherwise stated, prices are shown in U.S. dollars and may change without notice.
4. Orders and payment
Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or begin fulfillment. We may decline, cancel, or limit an order because of availability, suspected fraud, pricing or description errors, payment issues, destination restrictions, or other legitimate business reasons. Payments are processed through the payment methods made available at Shopify checkout. You represent that you are authorized to use the payment method provided and authorize the total charge shown at checkout.
5. Shipping and delivery
Available destinations, services, prices, weight limits, processing estimates, and customs responsibilities are described in our Shipping Policy. Delivery dates are estimates, not guarantees. To the extent permitted by applicable law, risk of loss and title pass when the shipment is delivered to the carrier. International customers are the importer of record and are responsible for destination-country laws, duties, taxes, VAT, customs, and import fees.
6. Returns, exchanges, and quality concerns
Coffee is non-returnable because it is a perishable food product prepared for freshness. Eligible unopened accessories may qualify for store credit or exchange as described in our Return and Refund Policy. Report damaged orders, incorrect items, or quality concerns within 30 days of delivery.
7. Subscriptions and purchase options
If you select a subscription or other purchase option, the price, billing frequency, discount, renewal terms, and cancellation information shown at checkout form part of your agreement. Recurring charges continue according to the selected plan until canceled in accordance with the purchase-options cancellation policy presented at checkout and on this site.
8. Intellectual property
The site and its content, including text, graphics, photographs, logos, product names, and design elements, are owned by or licensed to Heritage Blue Mountain Coffee and are protected by applicable intellectual-property laws. You may use the site only for personal, non-commercial shopping and informational purposes. No content may be copied, republished, sold, or exploited without prior written permission.
9. Acceptable use
You must not misuse the site, interfere with its operation or security, attempt unauthorized access, introduce malicious code, scrape or harvest data through unauthorized automated means, impersonate another person, submit false information, or use the site for an unlawful purpose.
10. Third-party services and links
The store uses Shopify and other service providers to support hosting, checkout, payments, communications, analytics, fulfillment, and security. Third-party services and websites may have their own terms and privacy practices. We are not responsible for third-party content or services beyond the responsibilities imposed by applicable law.
11. Disclaimers
Except as expressly stated and to the fullest extent permitted by law, the site and its content are provided on an “as is” and “as available” basis. We do not warrant uninterrupted access or that every error will be corrected. Nothing in these Terms excludes warranties, remedies, or rights that cannot legally be excluded.
12. Limitation of liability
To the fullest extent permitted by applicable law, Heritage Blue Mountain Coffee will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the site or products. Our aggregate liability for a claim relating to an order will not exceed the amount paid for that order, except where a greater remedy is required by law.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction in California, except where applicable consumer law requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. The revised version takes effect when posted with a new “Last updated” date. Continued use of the site after an update constitutes acceptance to the extent permitted by law.
